About these terms

These Terms and Conditions (“Terms”) govern your use of GetDesq, a web-based job search management platform operated by GetDesq Limited (“GetDesq”, “we”, “us”, “our”), a company incorporated in New Zealand.

By creating an account or using GetDesq, you agree to be bound by these Terms. If you do not agree, do not use the service. These Terms are governed by the laws of New Zealand.

The service

GetDesq provides tools to help job seekers organise their job search, including a kanban-style application tracker, CV builder, cover letter generator, skills bank, salary calculator, and recruiter collaboration features.

We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will give reasonable notice of material changes where possible.

Your account

To use GetDesq you must sign in with a valid Google account. You are responsible for maintaining the security of your account and for all activity that occurs under it.

You must be at least 16 years old to use GetDesq. By creating an account, you confirm you meet this requirement.

We may suspend or terminate your account if we reasonably believe you have breached these Terms, without liability to you.

Acceptable use

You agree not to:

• Use GetDesq for any unlawful purpose or in violation of any New Zealand law
• Attempt to gain unauthorised access to any part of the platform or another user’s account
• Introduce malicious code, viruses, or any software that could harm the platform or other users
• Scrape, copy, or redistribute any part of the platform without our written permission
• Use the platform to harass, abuse, or harm others
• Impersonate any person or entity
• Attempt to reverse engineer any part of the service

Your content

You retain ownership of all content you create or upload to GetDesq, including CVs, cover letters, job notes, and skills entries (“Your Content”).

By using GetDesq, you grant us a limited, non-exclusive licence to store, process, and display Your Content solely for the purpose of providing the service to you.

You are responsible for ensuring Your Content does not infringe the intellectual property rights of any third party or violate any applicable law.

AI-generated content

GetDesq uses artificial intelligence to help generate CVs, cover letters, interview questions, and other content. AI-generated content is provided as a starting point and is not a substitute for your own judgement.

You are solely responsible for reviewing, editing, and verifying any AI-generated content before using it. We make no warranties about the accuracy, completeness, or suitability of AI-generated content.

Salary calculator

The GetDesq salary calculator provides estimates based on publicly available New Zealand tax rates and is intended as a guide only. It does not constitute financial or tax advice. For accurate tax calculations, consult the Inland Revenue Department (IRD) or a qualified tax professional. Rates are based on the current financial year and may not reflect the most recent IRD updates.

Recruiter features

If you are a recruiter using GetDesq, you agree to use candidate information solely for legitimate recruitment purposes and in accordance with the New Zealand Privacy Act 2020. You must not share candidate information outside your organisation without the candidate’s consent.

Candidates control their connection with recruiters and may revoke access at any time. Upon revocation, you must cease using any candidate information obtained through GetDesq.

Intellectual property

All content, design, code, trademarks, and other intellectual property on the GetDesq platform (excluding Your Content) is owned by GetDesq Limited or its licensors. Nothing in these Terms grants you any rights to use our intellectual property other than as necessary to use the service.

Paid features and coaching

Some features of GetDesq, including salary negotiation and interview coaching sessions, may require payment. All prices are in New Zealand dollars and inclusive of GST where applicable. Payments are processed by third-party providers and are subject to their terms.

Coaching sessions are subject to separate booking terms provided at the time of purchase. Cancellation and refund terms will be communicated clearly before any purchase is made.

Disclaimers and limitation of liability

GetDesq is provided “as is” without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that any defects will be corrected.

To the maximum extent permitted by New Zealand law (including the Consumer Guarantees Act 1993 and Fair Trading Act 1986), we are not liable for any indirect, incidental, special, or consequential loss arising from your use of GetDesq, including but not limited to loss of data, loss of income, or missed employment opportunities.

Nothing in these Terms limits any rights you may have under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 that cannot be excluded by contract.

Privacy

Your use of GetDesq is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We comply with the New Zealand Privacy Act 2020.

Email communications

By creating an account, you agree to receive transactional emails necessary for the operation of the service. We also send an onboarding email series to new users. You may unsubscribe from non-essential emails at any time. All email communications comply with the Unsolicited Electronic Messages Act 2007.

Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by email or by a prominent notice within the platform. Continued use of GetDesq after changes take effect constitutes your acceptance of the updated Terms.

Termination

You may close your account at any time by contacting us at vivek@getdesq.co.nz. Upon account closure, we will delete your personal data within 30 days, subject to any legal obligations to retain certain records.

Governing law and disputes

These Terms are governed by the laws of New Zealand. Any disputes arising from these Terms or your use of GetDesq will be subject to the exclusive jurisdiction of the New Zealand courts.
